This is the English translation of the Japanese original 利用規約 (Term of use) which has been created in order to your reference.
In case there is a discrepancy between the Japanese original and the English translation, the Japanese original takes precedence.
The accuracy and the integrity of the English translation will not be responsible assurance by the rights holders.
The user may be expertised about the contents of the Japanese original 利用規約 (Term of use) by experts as necessary.

Terms of use

This terms of use (herein after called “the terms of use”) explains permission and prohibition of the usage of characters (such as images, designs, names…etc which shall be without any regard for a part of or all of, without limitation and so forth on. herein after called “the characters” ) and / or voice datas (herein after called “the voice datas” ) of “ VOCALOID4 『Fukase』(herein after called “the product” ) ” to users who buy and use the product and / or create derivative works with the product (herein after called “the user” ).
Any and all rights related the product are under the jurisdiction of Lastrum Music Entertainment Inc. and TOKYO FANTASY Inc. (herein after called “the rights holders” ).

Purposes of agreement of the term of use

Any usage, creation, publication, exhibition, distribution …etc of the characters / the voice datas (herein after called “the usage and others” ) are prohibited without permission of the rights holders by the laws of Japan.
Nevertheless of the above, the rights holders grant to the user the usage and others beyond the limits of the laws of Japan by the user’s agreement of the term of use.

1 : Permitted usage
A : The usage and others of derivative works of the characters / the voice datas shall be such as NON-commercial enterprise, NON-compensation nor NON earnings herein after called “the rights holders’ permitted usage”).
The user’s agreement of the term of use shall be regarded to be completed, engaged and effected by purchase and use of the product by which the user will have a permission of the rights holders’ permitted usage.
Example of the utility 1)
① The usage and others at the user’s own website, blog, SNS …etc on internet medium.
② The usage and others of illustration, drawing / painting and / or 3D figure, sculpture ..etc by the user’s own.
③ The usage and others of costume, dress, outfit …etc by the user’s own.
④ The usage and others of any and all member circle’s paper publications free of charge.
⑤ The usage and others of any and all member circle’s CD and / or DVD free of charge.
⑥ The usage and others of any and all member circle’s games free of charge.
⑦ The usage and others of picture book and / or photo book of COSPLAY, illustration, drawing, painting and / or 3D figure, sculpture ..etc free of charge.
⑧ The usage and others of costume, dress, outfit …etc free of charge.

B : To consign any production works to third party by the user’s own orders for user’s own private usage as following instance.
For avoidance of doubt, any products, goods…etc mentioned above shall NOT include any third parties’ intellectual property rights including any copyrights. The rights holders will NOT responsible to indemnify any resulting from any claim of third party’s.
The user shall NOT grant to the third party, who the user consigned and ordered to, to use their promotion, sales promotion, advertisement…etc as well as shall NOT grant to the third party who the user consigned and ordered to produce, create, sell …etc to any person except this relevant user.
Example of the utility 2)
① To order paintings, drawings, printings …etc of the characters’ illustration, photograph …etc on the user’s own vehicle, motor cycle, bicycle …etc by the user’s own.
② To order producing, creating, manufacturing …etc figure, doll, any three-dimensional object, sculpture …etc of the characters’ by the user’s own.
③ To order producing, creating, manufacturing …etc outfit, T-shit, flag, towel …etc of the characters’ by the user’s own.

C : The usage and others of the characters / the voice datas at educational institutions.
This usage shall be minimum and be liable for compliance with the regulations of copyright law as well as NON-commercial enterprise, NON-compensation nor NON-earnings at fields of education between pedagogue and education receiver.

2 : EULA (end-user license agreement)
The user shall be authorized by the rights holders before using the characters / the voice datas on terms described below.
A : The user, who is an legal entity, shall be authorized by the rights holders in advance without exception, by which the usage and others shall not matter NON-commercial enterprise, NON-compensation, NON earnings nor commercial enterprise, compensation, earnings…etc.
B : The user, who is an individual (which is including any and all parties except any legal entity), shall be authorized by the rights holders in advance, by which the usage and others are commercial enterprise, compensation, earnings…etc without exceptions.
C : The user, who is an individual (which is including any and all parties except any legal entity) and / or is an legal entity, shall be authorized by the rights holders in advance as flowing;-
This relevant user will create and / or produce…etc any materials by the usage and others of the characters / the voice datas (including any and all creative acts of derivative works without limitation) which will be commercial enterprise, compensation, earnings…etc to the public including any consignment without exceptions.
D : The user, who is an individual (which is including any and all parties except any legal entity) and / or is an legal entity, shall be authorized by the rights holders in advance as flowing;-
This relevant user will use their production(s) by the usage and others of the characters / the voice datas (including any and all creative acts of derivative works without limitation) to CM / CF (including a matter of tie-in) which will be opened to public on broadcasting of analogue medium, digital medium, on Radio, on TV…etc, any type of webcasting, streaming, on Internet, on Network…etc without limitation.
Those usages shall not matter NON-commercial enterprise, NON-compensation, NON earnings nor commercial enterprise, compensation, earnings…etc to the public.

* Warning;
For the clause 2-A, 2-B, 2-C and 2-D, The rights holders will NOT responsible nor guarantee to permit or engage an EULA.
Decision of permission and / or licensing authorities shall be retained to the rights holders.

3 : Prohibited usage
Any and all usage other than permitted usage on Clause 1 and NO exception.
Following usage will be strictly prohibited;
・　The usage and others of the characters / the voice datas for commercial enterprise, compensation, earnings…etc without EULA. (This may be caused to the violation of laws of Japan.)
・ The usage and others of the characters / the voice datas which seriously undermine or will undermine the image of the characters / the voice datas.
・　The usage and others of the characters / the voice datas which is or will be contrary to public order or morality
・ The usage and others of the characters / the voice datas which is or will be detrimental to the rights of any third parties’.
・ The usage and others of the characters / the voice datas which may be or will be caused misunderstanding to the rights holders’ (including but not limited any and all parties related the rights holders and / or the product.) official goods and products.

Important;
・ In case the user uses or will use any derivative works with the characters / the voice datas created by third party, The user shall be obtained permission not only the rights holders but also the rights holder of the derivative works.
The rights holders will NOT responsible to indemnify any resulting from any claim by third parties’ rights including copyrights of the derivative works excluding the rights holders’ own rights.
・ The user shall comply laws of Japan, copyright law, the term of use and other rules.
・　The user shall be in accordance with terms of use, EULA, and any agreement / contract …etc related and / or enclosed the product and / or the characters / the voice datas for any and all usage of the user with the product and the characters / the voice datas created with the product.
・ Unlimitedly any and all rights of modified, altered, revised the characters / the voice datas shall be remained to the rights holders.
・ Any rights of the characters / the voice datas, which is not notified on the term of use, shall be reserved to the rights holders.
・ The rights holders reserve rights to revise, add and/or remove a part of the term of use as appropriate and the user shall browse to ascertainment the updated term of use for the usage and others as needed.
The rights holders will NOT responsible to indemnify any resulting from any claim nor damnification related any revisions, additions and / or removals of the updated term of use.
